competition terms and conditions
The following terms and conditions apply for the Hot30
Countdown's Summer 30's Heads or Tails competition to be conducted
by the following radio stations: 2DAY FM, NXFM, B105 FM, FOX FM,
SAFM, 92.9 and FM104.7 (the "participating stations"). These terms
and conditions apply in conjunction with the above participating
stations' General Contest Rules. Where there is inconsistency, these
terms and conditions will prevail. Both these terms and conditions
and the participating stations' General Contest Rules can be collected
at the reception desks of 2DAY FM, NXFM, B105 FM, FOX FM, SAFM,
92.9 and FM104.7 and these terms and conditions can be downloaded
from the website at http://www.hot30.com ("website").
1. DURATION Registrations will be taken from 6pm Friday
30 December 2005 AEST to 6pm Friday 13 January 2005 AEST inclusive.
Contesting will occur between 7pm and 10pm local time weekdays from
Monday 2 January to Friday 13 January 2005 inclusive. The Grand
Final will take place on Monday 16 January 2005 between 9am and
5pm AEST.
METHOD OF ENTRY Entry is available to permanent residents
of New South Wales, Victoria, Queensland, South Australia Western
Australia and the Australian Capital Territory only. Each weeknight
the hot30 Countdown will invite listeners to register their details
via the website for their opportunity to be part of this contest.
To register, listeners must provide their contact details, personal
information and explain in 25 words or less why they love 50 Cent.
The hot30 team will then judge the most creative and entertaining
registration/s and give those listeners an opportunity to participate
in the competition ("Contestant"). The Hot30 team will choose two
(2) Contestants per week night. The Hot30 producer will call the
Contestant on their nominated telephone number weeknights off air
between 7pm and 10pm (AEST). If a Contestant is not available at
the time they are called, their name will be returned to the list
of registrations and an alternate Contestant will be selected and
so on until a Contestant is successfully contacted and consents
to play. Each night the Hot30 Host will get the two contestants
on-air and will allow one contestant (caller 1) to choose Heads
or Tails. The other contestant (caller 2) will have the opportunity
to convince caller 1 to change their mind. Once caller one has locked
in their decision, they will not be able to change their mind. The
Hot30 host will then flip a 50 Cent coin. If caller one is correct
they will win the major nightly prize and go into the Grand Final
to win the overall major prize. Caller Two will win the nightly
minor prize. If caller one is incorrect, caller two will win the
major nightly prize and go into the Grand Final to win the overall
major prize. Caller One will win the nightly minor prize. All Contestants
who qualify for the Grand Final are deemed Finalists. All decisions
of the hot30 are final and no discussions or correspondence will
be entered into. The hot30 may at its absolute discretion publicise
clues in relation to this competition in any medium. It may also
provide hints to contestants.
2. JUDGING The Grand Final The Grand Final will take
place between and Tuesday 3rd January to Saturday 14 January 2006
between 9am and 5pm (AEST). Finalists will be advised of the exact
time. Finalists must be available to participate in the Pop Quiz
at a time nominated by the hot30 between 9am and 4.59pm (AEST).
The hot30 team will call each Finalist. If the Finalist does not
answer their phone or make an attempt to contact the Hot30 to discuss
an appropriate/alternate time, they will be disqualified from the
Grand Final at 4.59pm (AEST) Saturday 14 January 2006. Each of the
Finalists will be given a Pop Quiz of the same five (5) questions,
which will be based on general knowledge and/or music played on
the Hot30. The Finalist who answers the most questions correctly
will be the winner of the Pop Quiz and the Grand Final. If there
is a tie between two or more Finalists, the same additional Pop
Quiz questions will be asked to those who have tied, until there
is one (1) winner who will be the Finalist who has answered the
most questions correctly overall.
3. PRIZE(s) There are ten (10) minor prizes: 4 x tickets
to the 50 Cent concert in the Winner's Capital City valued at $99
each = $396 Scheduled Show Dates/Venues/Tickets: Brisbane - Entertainment
Centre WED 15 FEB Sydney - Superdome FRI 17 FEB Melbourne - Rod

x 10 Total maximum value of all minor prizes: $3960 There is one
(1) major prize which is: " Return Economy Airfares for 2 people
from Winner's Capital City to London, UK, at a maximum of $3000
per person (travel must be taken on 16 January 2006, returning 19
January 2006) - valued at up to 6,000.00 " 3 nights twin share accommodation
in a 3.5 star hotel in London - valued at up to $1200.00 " Transfers
between airport / hotel/ airport - valued at up to $200.00 " 2 x
tickets to the London Premiere of Get Rich or Die Trying - Money
Can't Buy Total maximum value of major prize: $7,400 Total maximum
value of all prizes: $11,360 No other costs will be included and
all expenses and meals (other than those specifically referred to
above) will be at each winner's and other traveller's cost. Accommodation
is for room charges only. Prize must be taken on dates specified
and cannot be varied or extended. It will be each winner's and other
traveller's responsibility to take out all relevant travel and associated
insurance which may be required or prudent. All transport expenses
other than those specifically referred to above will be at each
winner's and other traveller's cost. Please note that the prize
does not include airport departure or government taxes, which must
be paid by the winner and other traveller where applicable.
4. USE OF PHOTOS etc. It is a condition of entry
that the participating stations have the right to publicise the
names, characters, likenesses or voices of any contestants for any
promotion or matter incidental to the competition. Winners may also
be required by the participating stations to participate in a photo,
video and/or film session and acknowledges that the participating
stations have the right to use such publicity photos, videos and/or
films in any medium (including, without limitation, the internet)
and in any reasonable manner they see fit, unless that person advises
the participating stations at the time of entering the competition
that he/she wishes to retain his/her anonymity. Contestants also
acknowledge that their photo may be used for a promotional display
at the prize providers' locations. Contestants consent to their
entry being read out on air and to their telephone and other conversations
with the participating stations being broadcast on air.
5. INDEMNITY All contestants release from, and indemnify
Radio Newcastle Pty Ltd (ACN 000 225 525) Consolidated Broadcasting
System (WA) Pty Ltd (ACN 008 670 460), Canberra FM Radio Pty Ltd
(ACN 074 733 823) and Austereo Pty Ltd (ACN 007 914 641) against,
all liability, cost, loss or expense arising out of acceptance of
any prize(s) or participation in the competition including (but
not limited to) loss of income, personal injury and damage to property
and whether direct or consequential, foreseeable, due to some negligent
act or omission or otherwise.
6. NOTIFICATION All prize winners will be notified
on air at the time of winning, by telephone and in writing. All
prize winners from Victoria of $250 or more will be published in
the Herald Sun on Wednesday 18 January 2006.
7. COPYRIGHT By entering this competition all entrants:
" consent to Austereo Pty Ltd making copies of the whole or any
part of their entry; " grant to Austereo Pty Ltd all present and
future copyright and all other rights in their entry in all media
(including, without limitation, the internet) and whether in existence
now or created in the future; and " undertake to Austereo Pty Ltd
that their entry is not in breach of any third party intellectual
property rights.
8. All prizes are non transferable, non exchangeable,
must be used on the dates specified above (where applicable) and
are not redeemable for cash.
9. The winner will be responsible for any and all
taxes incurred in relation to their receipt of the prize(s). Winner/s
should seek independent financial advice prior to accepting a prize
if this is a concern.
10. If a registered listener from South Australia
is not available at the time they are called, they will win a CD
valued at approximately $30, and will be notified in writing within
14 days of winning, that they have won and how to collect their
prize.
11. No person may enter this contest more than once.
12. Except for SA residents, no person may win more
than one (1) prize. In the event that the hot30 becomes aware that
the same person has been selected as a winner more than once, the
hot30 will cause another name to be drawn/selected in their place.
All decisions and actions of the hot30 are exercised according its
absolute discretion and are final. No discussions or correspondence
will be entered into.
13. Employees and their immediate families of the
participating stations, Radio Newcastle Pty Ltd, Consolidated Broadcasting
System (WA) Pty Ltd, Canberra FM Radio Pty Ltd and Austereo Pty
Ltd are ineligible to enter. Employees and their immediate families
of all associated sponsors and participating companies are also
ineligible to enter.
14. If a winner is under the age of 18 years, their
prize may at the absolute discretion of the participating stations
be awarded to that winner's parent or legal guardian.
15. If a winner under the age of 18 years is permitted
by the participating stations in their absolute discretion to accept
a prize, that winner must nominate a parent or legal guardian as
their accompanying "friend" for the trip.
16. The winner and the person proposed to accompany
them must not engage in any illegal or unsafe behaviour whilst travelling.
17. The winner and the person proposed to accompany
them must have and maintain valid passports endorsed with all relevant
visas and with expiry dates no less than six (6) months following
the proposed dates of travel. These passports, and their holders,
must not be subject to any restrictions on their rights to travel
to and from the UK.
18. The winner and the person proposed to accompany
them must have a medical examination and obtain a written clearance
to travel from an examining medical practitioner acceptable to Austereo
Pty Ltd.
19. If in the course of a telephone call the telephone
line drops out or breaks up the participating stations may proceed
to another caller. In such event, the participating stations will
not be responsible for the awarding of any prize to the caller whose
line dropped out or broke up.
20. If for any reason this competition is not capable
of running as planned (including but not limited to) technical failures,
unauthorised intervention, computer virus, mobile phone failure,
tampering, fraud or any other causes beyond the control of Austereo
which corrupts or affects the administration, security, fairness,
integrity or proper conduct of this competition, the participating
stations reserve the right, subject to State legislation, to disqualify
any individual who tampers with the entry process, and to cancel,
terminate, modify or suspend the competition.
21. The participating stations, Radio Newcastle Pty
Ltd, Consolidated Broadcasting System (WA) Pty Ltd, Canberra FM
Radio Pty Ltd and Austereo Pty Ltd will not be responsible or liable
if for any reason beyond their reasonable control any element of
any prize is not provided. The participating stations may, subject
to State Regulations, substitute a different prize of equivalent
value in place of any prize referred to in these terms and conditions.
22. All winners must sign these terms and conditions
and the applicable participating station's General Contest Rules
both in a form prescribed by Austereo Pty Ltd in order to receive
their prize. In the event that a prize winner under the age of 18
years is permitted to accept a prize, these terms and conditions
and the applicable participating station General Contest Rules must
be signed by their parent or legal guardian.
23. All winners of the major prize must execute a
Deed of Release and Indemnity in a form prescribed by Austereo Pty
Ltd in order to receive the major prize. In the event that a prize
winner under the age of 18 years is permitted to accept a prize,
the Deed of Release and Indemnity must be signed by their parent
or legal guardian.
24. It is also a condition of entry that the winner
and the person proposed to accompany them must both execute a Deed
of Release and Indemnity in a form prescribed by Austereo Pty Ltd
in order to receive the major prize. In the event that a prize winner
under the age of 18 years is permitted to accept a prize, their
Deed of Release and Indemnity must be signed by their parent or
guardian.
25. It is also a condition of entry that contestants
proposing to undertake stunts or challenges may at the absolute
discretion of Austereo Pty Ltd first be required to execute a Deed
of Release and Indemnity in a form prescribed by Austereo Pty Ltd
in order to participate further in the competition. In the event
that a prize winner under the age of 18 years is permitted to accept
a prize or participate in a challenge, the Deed of Release and Indemnity
must be signed by their parent or legal guardian.
26. The participating stations may, subject to State
regulations, terminate this competition at any time at their absolute
discretion without liability to any contestant or other person.
27. In all matters, all decisions of participating
station staff will be final and cannot be contested. No correspondence
or discussions will be entertained.
28. Obtaining time off work and/or study and/or related
activities to participate in this competition will be the sole and
absolute responsibility of each contestant.
29. The participating stations reserve the right to
exclude any persons from the competition on the ground of their
medical condition or history or any reason whatsoever.
30. The personal information supplied by entrants
will be used by Hot30 Countdown to conduct the contest and to contact
entrants if they are a winner. The information may also become part
of a database kept by Hot30 Countdown used to let entrants know
about special offers from Hot30 Countdown and new developments.
Please refer to our Privacy Policy for more information as entry
in this contest is an agreement to be bound by that policy. Our
current Privacy Policy is available at http://www.hot30.com or from
the participating station's reception. All entrants may have their
details removed from the database at any time by simply contacting
their local station.
31. PROMOTER The promoter is Radio Newcastle Pty Ltd
